Acceptance
This document (the “Legal Mentions and General Conditions of Use”) is applicable to the entire content of the website www.upscalehr.com (hereinafter the “Site”).

The Site is intended to present UPSCALE HR Consulting and to provide Users with information relating to the services offered by the firm.

Access to and use of the Site are governed by these Legal Mentions and General Conditions of Use.

The User undertakes to read these Legal Mentions and General Conditions of Use and accepts them as a contractual element.

SAS UPSCALE HR Consulting (hereinafter “Site Owner”) reserves the right to modify the Site as well as the Legal Mentions and General Conditions of Use at any time, or to supplement them with new complementary contractual conditions. Users are therefore advised to regularly consult the Legal Mentions and General Conditions of Use, in order to refer to the latest version in force.

Privacy and personal data

The User is required to provide information about himself when he uses the Site, in particular when he connects to the Site from a fixed or mobile terminal or when he fills in a form on the Site. In addition, certain non-personal information (metadata) may be collected, such as the User’s browser version or the type of operating system used.

The recipient of the data is the Site Owner. The data may not be sold, rented or disclosed to other recipients without the prior consent of the User. The data may however be communicated in application of a law, a regulation, a decision of a regulatory or judicial authority, in particular in the case of prevention against fraud on the Site.

The data may be transmitted, after prior agreement by the User, to Service Providers or Customers located outside the European Union. When this is the case, the data is processed according to the recommendations of the European Commission.

Browsing the Site may result in the installation of cookies on the User’s fixed or mobile terminal. This cookie does not allow the identification of the User but records information relating to his navigation. These are intended to facilitate subsequent navigation on our Site and allow us to measure the number of visitors. In application of the GDPR, the conditions for storing personal data are the following:

  • for customers, the lawful basis is “contractual necessity” for us to be able to carry out our research mandate and commercial follow-up;
  • for candidates, the lawful basis is “legitimate interest” so that we may present him/her with career opportunities and keep track of his/her whereabouts.

Personal data may be kept and used for a period of two years from the User’s last contact. They may be kept beyond this period but only for statistical purposes.

In accordance with the French law “Informatique et Libertés” n° 78-17 of 6 January 1978 amended in 2004 and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals and on the processing of personal data and on the free movement of such data, the User has a right of access, rectification, deletion, limitation and opposition to the processing of his/her personal data.

For personal data collected after the User has given his consent, he may withdraw his consent at any time, without prejudice to the lawfulness of the processing.

The User has a right to the portability of his personal data and the right to define guidelines regarding the fate of his personal data if he can no longer exercise them.

Applicable law
The official language of these Legal Mentions and General Conditions of Use is French. In the event of any difference, inconsistency or conflict between this version and the translated version, the French version shall prevail.

Any dispute arising out of the use of this Site, or the performance or interpretation of this Site, shall be subject to the jurisdiction of the courts of Paris, unless otherwise provided by law or regulation.
